Presidential candidate Donald Trump, the well renowned real-estate mogul and celebrity, has caused tremendous controversy over his now infamous 2016 campaign trail. Mr. Trump’s antics have gained the attention of many influential people, including successful doctors, lawyers, and real-estate elite living in Beverly Hills, however these antics have pushed one New York State citizen to file a ONE BILLION DOLLAR lawsuit.

Louis Tafuto, a registered Republican in upstate New York, is demanding his attorney to sue Donald Trump, Mike Pence, and other Defendants in a lawsuit, claiming that Mr. Trump is menacing our citizens before (and during) election day. Mr. Tafuto’s attorney is using Mr. Trump’s bold sentiments of unacceptance to results of this election if he loses. As such, Mr. Tafuto is claiming that Mr. Trump’s entire demeanor and antics are destroying our democratic system.

Though I agree with some of Mr. Tafuto’s perceptions of the effect Mr. Trump has and will have on our democratic society; a New York judge will be hard-pressed to agree with Mr. Tafuto’s claims, specifically his claim of intentional inflection of emotion distress. Mr. Tafuto is claiming Mr. Trump’s behavior is causing severe emotional distress to him and others if he does not accept the results of this Presidential election, and as such Mr. Tafuto does not have “an honest and capable Republican candidate.”

Intentional inflection of emotional distress has four core elements, that must be proven by the Plaintiff. First, the Defendant must act intentionally or recklessly. Second, the Defendant’s conduct must be extreme and outrageous. Third, the Defendant’s reckless or intentional conduct must cause the emotional distress to occur (this prong usually needs some sort of professional or doctor to make the causation link, which is often very hard). Lastly, the Plaintiff in fact must suffer severe emotional distress.

Now I know many of you will build an argument for each element, like Mr. Tafuto’s legal team is attempting to do, but are Mr. Trump’s actions extreme or outrageous? Further, how can a bench determine that a “terrible candidate” in a political party caused Mr. Tafuto severe emotional distress? Hopefully our efforts today will reveal our countries true beliefs, regardless of the results.
